Terms of Service

1. Who this agreement is with

POVshare is operated by Lucid Systems LLC, 5473 Blair Rd Ste 100 PMB 964735, Dallas, TX 75231-4227 (“POVshare,” “we,” “us”). These Terms govern your use of povshare.com and the live photo wall, gallery, and related features (the “Service”). By creating an event, uploading a photo, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What POVshare is

POVshare lets a host create an event, share a QR code with guests, and collect the photos and videos guests upload onto a live wall and gallery. Guests do not need an account. A host may optionally enable AI content screening, a music bed, guest song requests, and other features described on the pricing page.

3. Accounts and eligibility

You must be at least 18 years old to create a host account and purchase a plan or gift code. You are responsible for keeping your login credentials confidential and for everything that happens under your account, including actions taken by anyone you give access to as a co-host.

Guests do not create accounts. A guest who scans an event’s QR code and uploads a photo is bound by the parts of these Terms that describe acceptable content (Section 6) even without registering.

4. Your content, and the license you grant us

You own whatever you upload — your photos, videos, captions, and event details. By uploading content to the Service, you grant POVshare a worldwide, royalty-free, non-exclusive license to host, store, reproduce, transmit, and display that content solely to operate the Service: showing it on the live wall and gallery, generating thumbnails and previews, and delivering it to the host and (where the host allows) other guests. This license ends when the content is deleted, except for backup copies that are purged in the ordinary course of our systems.

Hosts are responsible for their event: who they invite, whether they enable moderation, and what ends up on their wall. If a host links their event to another host’s event (Section 8), photos uploaded to either event may become visible on both, as configured by the hosts.

5. Content moderation

On plans that include it, uploaded images are automatically screened by an AI moderation service before they can reach the live wall; content the screen flags is rejected, not approved on our behalf. Everything else is subject to whatever manual review setting the host has chosen — full manual approval, or open by default. POVshare does not manually review every photo, and hosts are responsible for monitoring their own event. We may remove content or suspend an event at our discretion if we become aware it violates these Terms.

6. Acceptable use

You agree not to upload or share content that:

  • is illegal, or that you do not have the right to share;
  • infringes someone else’s copyright, trademark, or other rights;
  • is sexually explicit, or depicts a minor in an unsafe or exploitative way;
  • harasses, threatens, or is intended to harm a specific person;
  • contains malware or is designed to disrupt the Service.

You also agree not to attempt to bypass moderation, scrape or bulk-extract other events’ content, or use the Service to build a competing product.

7. Music and streaming-service connections

POVshare provides a licensed music catalog you may play on your event’s wall at no additional cost. A host may separately choose to connect their own Spotify or Apple Music account. That connection is between the host and their own streaming account — it plays on the device the host connects, using the host’s own subscription, and is subject to that provider’s own terms. POVshare is not a party to, and does not warrant, a host’s streaming subscription. A connected streaming account may only be used for personal, non-commercial listening consistent with that provider’s own terms of use; POVshare does not grant any additional rights to that content.

8. Plans, event windows, and gift codes

Paid plans are billed once per event through Stripe. We never see or store your full card number. Current pricing and what each plan includes are listed on our pricing page, which forms part of these Terms by reference.

Each plan has an event window — how long the live wall and gallery stay reachable at your event’s link (currently 24 hours on Free, 30 days on Plus, 90 days on Pro from when the event is created). After that window, the live wall and gallery stop accepting new uploads and are no longer publicly displayed. This is a change in display and access, not an automatic deletion of your underlying files — see the Privacy Policy for how retention actually works and how to request deletion.

A gift code covers one Plus event and does not expire. Refunds are not automatic; contact support@povshare.com and we will look at your situation individually. We do not commit in advance to a specific refund window or amount.

9. Co-hosts and event linking

A host may invite another POVshare user to act as a co-host on their event, and separately may link two related events together (for example, two related celebrations run by different hosts). Both are opt-in and controlled from the dashboard. Linking two events is a paid feature and, once active, mixes each event’s photos into the other’s gallery at a ratio the hosts choose. Unlinking stops new sharing between the events going forward.

10. Our intellectual property

The POVshare name, logo, and the software behind the Service belong to Lucid Systems LLC. These Terms do not grant you any right to use our branding except to the extent needed to use the Service as intended (for example, displaying your own event’s QR code).

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate an account or event, without advance notice, if we reasonably believe it violates these Terms, creates legal risk for us or others, or is being used to abuse the Service. Sections of these Terms that by their nature should survive termination (ownership, disclaimers, liability limits) do so.

12. Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee the Service will be uninterrupted, error-free, or available at any particular moment — including during your event. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Because a live event is time-sensitive and cannot be rescheduled by us, we strongly recommend testing your setup before guests arrive — see our setup guide.

13. Limitation of liability

To the extent the law allows, Lucid Systems LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the event giving rise to the claim in the twelve months before the claim arose.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Dallas County, Texas.

15. Changes to these Terms

We may update these Terms as the Service changes. We will update the date at the top of this page when we do. Continuing to use the Service after a change means you accept the updated Terms.
